Construction

ConstructionCompliance that doesn't stop the site.

We build for construction because we build in construction. SafeFile is our own platform, structured to the Occupational Health and Safety Act and the Construction Regulations — which means the regulatory detail on this page comes from having implemented it, not from having read about it.

The pressures

What actually costs money in construction.

  • 01A closure notice costs more than the paperworkAn inspector who finds an incomplete health and safety file can halt operations on the spot. The cost is never the document — it is the standing time, the delayed programme and the penalty clauses that follow.
  • 02Subcontractor liability transfers to youWithout a signed Section 37(2) mandatary agreement, the principal contractor carries responsibility for subcontractor conduct. On a site with several subcontractors that exposure compounds quickly.
  • 03Verification at the gate is guessworkConfirming that a worker holds a valid medical clearance and has completed induction usually depends on someone remembering. At shift change, with a queue forming, it does not happen reliably.
  • 04Tenders are won and lost on credibilityClients and quantity surveyors research contractors before they shortlist. A site presence that looks dormant undermines a bid that was otherwise competitive.

Regulatory context

What the law requires.

Construction Regulation 7

Requires a principal contractor to maintain a site-specific health and safety file, available for inspection.

Section 37(2), OHS Act 85 of 1993

A written mandatary agreement is what separates your liability from your subcontractor’s. Without it, their conduct is your exposure.

Construction Regulation 9 — HIRA

Mandates documented, continuing hazard identification and risk assessment for site activities.

COID Letter of Good Standing

Compensation Fund standing must be current and evidenced. Expiry is a common and avoidable audit failure.

This is a summary of requirements we have implemented against, not legal advice. Confirm your obligations with a qualified practitioner before relying on them.
